Following the Federal Trade Commission’s January 2023 proposed rule that would effectively ban non-compete agreements nationwide, in February a bipartisan group of U.S. Senators and Representatives re-introduced the “Workforce Mobility Act of 2023” which likewise would ban employer non-compete agreements. We'll explore why a business owner should consider this proposed ruling when contemplating a transition and how to ensure this doesn't disrupt your M&A process.
